Developer in Gurugram faces police complaint for neglecting three affordable housing projects
In a significant development, the Haryana Development and Regulation of Urban Areas Act, 1975 has been invoked against Ocean Seven Buildtech Pvt Ltd (OSB) due to the company's failure to complete three affordable housing projects and alleged financial irregularities.
The developer, OSB, was supposed to deliver these residential societies within four years and hand over the possession of the flats to the buyers. However, none of these projects have been completed, and they have remained stalled since 2019 with negligible construction progress.
The licenses of these projects stand suspended since February 2023, following OSB's default on payment of outstanding dues amounting to approximately ₹21 crores against the aforementioned licenses.
The Department of Town and Country Planning (DTCP) has registered a first information report (FIR) against OSB Developers for these violations. The FIR recommends multiple irregularities, including incomplete projects and buyers' complaints of multiple sales of the same unit, diversion of funds, and failure to complete construction since 2019.
Numerous complaints have been received from home buyers regarding cancellation of units during the suspension period, delay in completion of projects, and non-refund of deposits. It's worth noting that nearly 95% of buyer payments have been collected against only 62.5% construction completed in one of the projects.
Swaraj Singh, the owner and director of M/s Ocean Seven Buildtech Pvt. Ltd., is at the centre of the controversy. Investigations are underway, and authorities are seeking a lookout circular to prevent him from fleeing the country.
The district town planner (enforcement) Amit Madholia submitted the complaint to the Haryana Enforcement Bureau and asked police to issue a look out notice for promoter Swaraj Singh, apprehending that the developer may try to abscond.
Three licenses were issued to OSB Developer under the affordable housing scheme to develop projects in Sector 109 in 2016, Sector 70 in 2019, and other unspecified locations. Unfortunately, OSB Developer has submitted false progress reports and has shown non-cooperation with the forensic audits ordered by DTCP and HRERA.
A meeting is scheduled in Chandigarh to resolve the issues between OSB Developers and the department. This move aims to bring clarity and ensure justice for the affected home buyers. The Haryana State Enforcement Bureau (HSEB) will continue to investigate and take criminal action against illegal activities such as the ones alleged against OSB Developers.
